Terms & Conditions

These Terms and Conditions (the “Terms” or “ToS”) form a binding agreement between You and the Company and govern Your access to and use of the FabFunnel Services, including our websites, applications, APIs and related tools (together, the “Platform”).

By creating an account, clicking “Start free trial”, or otherwise accessing or using the Platform, You confirm that You have read, understood and agree to be bound by these Terms and by our Privacy Policy. If You do not agree, You must not use the FabFunnel Services.

Capitalised terms used in these Terms have the meanings given below; any terms not defined here carry the meaning given in our Privacy Policy.

• (i)Customer Data — any data, content or information You or Your End-Users submit to, generate within, or connect to the Platform.
• (ii)End-User — any person You permit to access the Platform under Your account or workspace.
• (iii)Workspace — the billing and team boundary under which the FabFunnel Services are provided to You.
• (iv)AI Credits — the metered currency that powers the AI features, included monthly per plan and toppable at any time.

You must be at least 18 years old and capable of forming a binding contract to use the FabFunnel Services. You are responsible for the accuracy of the information You provide and for all activity that occurs under Your account.

You are responsible for safeguarding Your login credentials and for the acts and omissions of Your End-Users. You must notify us promptly at support@fabfunnel.com of any unauthorized use of Your account.

You agree to use the Platform only for lawful purposes and in compliance with these Terms and the policies of any connected advertising network. You shall not:

• (a)Violate any applicable law, regulation or third-party right, or the advertising policies of Meta, TikTok, NewsBreak or any other connected network;
• (b)Upload malicious code, attempt to gain unauthorized access to the Platform, or interfere with its integrity or performance;
• (c)Resell, sublicense or misrepresent the FabFunnel Services, or use them to build a competing product;
• (d)Use the AI features to generate unlawful, deceptive, or infringing creative.

Paid plans are billed per workspace and may be charged monthly or annually as selected on the pricing page. Paid Growth plans include a 14-day free trial; a valid payment card is required to start, and the first charge is taken on day 15 — the day after the trial ends — unless You cancel before then.

Annual billing is charged for ten months, saving the equivalent of two months versus monthly billing. AI Credits are billed on top of plan access and may be topped up at any time. Fees are non-refundable except where required by law.

As between You and the Company, You retain all rights in Your Customer Data. You grant us a limited, worldwide licence to host, process and display Your Customer Data solely to provide and improve the FabFunnel Services.

The Platform, including all software, models, designs and the FabFunnel name and marks, is and remains the property of the Company and its licensors. Nothing in these Terms transfers any ownership of our intellectual property to You.

The FabFunnel Services connect to and rely on third-party platforms and APIs, including Meta, TikTok, NewsBreak, Google and tracking integrations such as RedTrack and Voluum. Your use of those platforms through FabFunnel is also subject to their respective terms and policies.

We are not responsible for the availability, accuracy, or actions of third-party platforms, and changes they make to their APIs or policies may affect the FabFunnel Services. You are responsible for maintaining advertising accounts in good standing with each network.

The FabFunnel Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement.

We do not warrant that the Platform will be uninterrupted or error-free, or that any particular advertising outcome, performance, or return on ad spend will be achieved.

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to Your use of the FabFunnel Services.

Our total aggregate liability arising out of or related to these Terms shall not exceed the amounts paid by You to the Company for the FabFunnel Services in the twelve (12) months preceding the event giving rise to the claim.

These Terms remain in effect for as long as You use the FabFunnel Services. You may stop using the Platform and cancel Your subscription at any time. We may suspend or terminate access where You materially breach these Terms or where required to protect the Platform, its users, or to comply with law.

On termination, Your right to access the Platform ends. Provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability and governing law — will survive termination.

These Terms are governed by the applicable laws of the Company’s jurisdiction, without regard to conflict-of-law principles. The courts of that jurisdiction shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms.

We may update these Terms from time to time. Where changes are material we will provide reasonable notice; Your continued use of the FabFunnel Services after the changes take effect constitutes acceptance of the revised Terms. Questions? Email support@fabfunnel.com.
